Privacy Policy

Introduction and acceptance

Welcome to the MBG website, accessible at https://mbgroup.ca/ (the “Website”), which includes all current and future subdomains. We hope you enjoy your visit and/or use of the Website. By visiting and/or using the Website, you agree to be bound by the terms of this Privacy Policy (the “Policy”).

The Website is owned and operated by MBG Inc., a company duly incorporated in the province of Quebec, Canada. When this Policy refers to “MBG,” it may mean the Website or MBG Inc. (and/or its officers, directors, employees, agents or representatives), or both, depending on the context.

The Policy was last modified on April 10, 2019. MBG reserves the right to modify or replace any provision of the Policy at any time and without prior notice. Any changes to the Policy are available at this address. It is your responsibility to regularly review the Policy for changes. Your use of the website following the posting of any changes to the Policy constitutes acceptance of these changes.

The Policy should be read in conjunction with the Terms of Use, as both documents govern your use of the Website.

In this Policy, a visitor or user of the Website may be referred to as “you”. MBG may sometimes be referred to as “we”.

General Declaration of Confidentiality and Protection of Personal Information

MBG places great importance on the confidentiality and security of your personal information. We have established a secure environment and implemented a strict policy that describes the limits of use and access to this information.

What does this privacy policy cover?

This Policy covers the treatment of personally identifiable information (“Personal Information”) and other information collected by MBG when you use or access the Website. It also covers MBG’s treatment of Personal Information that MBG may share with its business partners or other third parties in very limited circumstances.

This Policy does not apply to the general practices and treatment of information (personal or otherwise) by third parties that MBG does not own or control, including, but not limited to, third-party websites or services that you choose to access through the Website or via a link on the Website (“Third-Party Website”), or individuals that MBG does not manage or employ. While we strive to facilitate access to or link only to those Third-Party Websites that share our respect for your privacy, we cannot be responsible for the content or privacy policies of these Third-Party Websites. We encourage you to carefully review the privacy policies of any Third-Party Website you access. We have cited and provided links to the most prominent Third-Party Websites later in this Policy.

Finally, this Policy does not cover personal information you transmit to MBG through unsecured means of communication such as email, instant messaging, or Twitter, as these communications may be intercepted, lost, or altered. We welcome your comments, requests, and suggestions, but we encourage you to carefully consider the personal information you transmit to MBG through these means.

No collection of personal information is mandatory

MBG does not systematically collect any personal information about you when you visit or use the website, unless you are asked to provide it, for example by filling out the contact form, the quote form, or the application form. Personal information is only collected with your informed consent. When you provide personal information, it will only be used for the purposes stated, for example, to respond to your request.

Information security and encryption

MBG exclusively applies industry best practices (physical, electronic, and procedural) to secure the data collected (including personal information). In addition, MBG uses third-party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to operate the Website. These third parties have been selected for their high standards of security, both electronic and physical.

Limited collection of information for statistical, analytical and security purposes

MBG automatically collects certain information using Google Analytics, a third-party analytics software, to understand how our users use the Website. However, none of this information identifies you personally. For example, each time you visit the Website, we automatically collect your IP address, browser and computer type, access times, the referring web page, and the web page(s) you access (if any). We use the information collected in this way only to better understand your needs and those of the Website’s users as a whole. MBG also uses the information collected for statistical purposes to track the number of visits to the Website and its specific pages in order to make improvements.

Your IP address and other relevant information may be used to trace any fraudulent or criminal activity, or any activity contrary to the Terms of Use.

Non-disclosure of personal information to third parties

Except as otherwise provided in the following paragraph and the following section of this Policy entitled “Third-Party Services,” MBG does not disclose any personal information collected through the Website to third parties. Furthermore, MBG does not sell, rent, trade, or license any personal information about its users to third parties.

Only MBG employees, representatives, contractors, officers, agents, or assigns are responsible for the management and development of the Website, and only these individuals have access to the information collected therein. These employees, representatives, contractors, officers, agents, or assigns have all been required to comply with the Policy.

Notwithstanding anything to the contrary in the Policy, we may share any information we have collected about you or that you have submitted: (1) in response to subpoenas, court orders, or legal process, or to establish, protect, or exercise our legal rights or defend against legal claims or demands; (2) if we believe it is necessary to investigate, prevent, or take action regarding illegal activities, fraud, or situations involving potential threats to the safety of any person, or any violation of the Terms of Use; (3) if we believe it is necessary to investigate, prevent, or take action regarding situations involving abuse of the Website infrastructure or the Internet generally (such as high-volume spam, denial-of-service attacks, or attempts to compromise the security of the Website infrastructure or the Website generally); (4) to a parent company, subsidiaries, joint ventures, or other companies under common control with MBG (in which case we will require those entities to comply with this Policy); (5) if MBG is acquired by or merged with another entity (in which case we will require that entity to assume our obligations under this Policy, or notify you that you are covered by a new Privacy Policy).

Third-party services

MBG uses certain third-party services to enhance its website. Personal information may be transferred from MBG to these third-party services, but only to the extent necessary for their proper functioning and only after your express consent. These third-party services include Facebook, Twitter, LinkedIn, and Google+ for sharing content, including blog posts. If you are not already logged into these third-party services, your personal information required to log into these accounts is securely transferred from MBG to these third-party services. When your personal information is transferred to these third-party services, it is subject to their respective privacy policies, which we encourage you to review.

Additionally, MBG uses certain third-party services to add functionality to the website. Personal information may be transferred from MBG to these third-party services, but only to the extent necessary for their proper functioning and only after your express submission. These third-party services are limited to: (1) Salesforce for Customer Relationship Management (CRM), which accepts data (including personal information) directly from contact, partnership, and submission forms. While we store personal information collected through these forms with Salesforce’s CRM software, this information is only used to respond to your inquiries and/or follow up, if necessary. All MBG email activities comply with Canada’s Anti-Spam Legislation (“CASL”, S.C. 2010, c. 23). MBG also uses Salesforce to send its newsletter, and we store your email address with Salesforce for this purpose.

The third-party services mentioned in this section are currently the only third-party services used on the website. However, MBG reserves the right to add third-party services in the future. In this case, this section will be updated accordingly.

Access and deletion of personal information

If you wish to review the personal information that MBG holds about you and/or have it permanently deleted from our records, please contact us via the online form or using the contact details provided above in this Policy.

Tracking Technology (“Cookies”)

MBG uses tracking technology (“Cookies”) on the Website and, by using the Website, you agree to their use. Cookies are small text files placed on your hard drive when you visit a website. They track your usage and improve the user experience by storing certain data on your computer. The Website uses “Session Cookies,” which improve your user experience by storing certain information on your computer about your current visit. Other cookies are also used, for example, to store your email address or other information (such as your name) in certain form fields, to avoid having to re-enter it in other forms.

Your browser can be configured to refuse cookies or delete them after they have been stored. Please consult the help section of your browser for instructions. Please note that deleting these cookies may reduce your user experience on the Website by requiring you to re-enter certain information, such as your email address. MBG will not be held liable for any features that may not work after deleting cookies, or for any damages (pecuniary or otherwise) resulting from the non-functioning of these features or their reduced functionality.

Risks associated with the Internet

Despite MBG’s best efforts to prevent third parties from accessing or obtaining your Personal Information through your use of the Website, complete confidentiality and security cannot currently be guaranteed over the Internet. Communications via the Internet are subject to interception, loss, or alteration. You acknowledge and agree that MBG cannot be held liable for any damages resulting from the transmission of confidential information or Personal Information over the Internet and that such communications are at your own risk.

Limitation of liability

MBG, and/or its officers, directors, owners, managers, partners, partnerships, principals, employees, affiliates and other related entities, servants, agents, representatives, successors and assigns, shall not be liable for any damage, direct or indirect, pecuniary or otherwise, resulting from the misuse of information collected by a third party, or from any misuse of information collected through the Website that does not contravene the Policy.

Compliance with privacy laws

This policy and MBG’s general practices are designed to comply with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) (S.C. 2000, c. 5) and Quebec’s Act respecting the protection of personal information in the private sector (R.S.Q., c. P-39.1). For any questions regarding this compliance, please contact us via the contact form.
